Home Buyers Warranty Corporation Builder Awards Contest (“Contest”) Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. ENTRY INTO THIS CONTEST IS IN NO WAY RELATED TO OR CONTINGENT ON REFERRALS OF BUSINESS TO SPONSOR (as defined below).
WHO MAY ENTER: THIS CONTEST IS OPEN TO PARTIES THAT HAVE A FACEBOOK, INSTAGRAM, TWITTER AND/OR PINTEREST PAGE/ACCOUNT AND ARE NATURAL PERSONS WHO ARE 18 YEARS OF AGE OR OLDER, ATTEND THE KELLER WILLIAMS MEGA AGENT CAMP 2023, AND RECEIVE A TOTE BAG PROVIDED BY KELLER WILLIAMS (“TOTE BAG”). ONLY ENTRANTS ATTENDING THE KELLER WILLIAMS MEGA AGENT CAMP 2023 (“MEGA CAMP”) AND FITTING THE CRITERIA MENTIONED ABOVE ARE ELIGIBLE TO ENTER THE CONTEST. YOU MAY NOT PARTICIPATE IF YOU ARE NOT A LEGAL U.S. RESIDENT OR ENTITY AND PHYSICALLY LOCATED WITHIN THE U.S. AT THE TIME OF ENTRY. The following persons are not eligible to enter the Contest: (a) employees of Home Buyers Warranty Corporation, its parents, affiliates, subsidiaries, officers or employees; (b) officers, employees or agents of any organizations directly involved with this Contest, including any co-sponsor of the Contest; (c) immediate family members and persons living in the same household as the persons identified in (a) and (b) above. Void where prohibited or restricted by law.
HOW TO ENTER: Enter the Contest by visiting Booth # 307 (the “Booth”) at the Mega Camp hosted August 14-16, 2023 at the Austin Convention Center, 500 E Cesar Chavez Street, Austin, TX 78701, fully fill out the entry postcard inside the Tote Bag titled, “2-10 Home Buyers Warranty Social Media Contest 2023” (“Entry Card”), and posting a selfie with a Booth representative to your Facebook, Instagram, X f/k/a Twitter and/or Pinterest account of the entrant and a Sponsor representative. Submission must be a single photograph. Entries must be submitted by posting on Facebook, Instagram, X f/k/a Twitter, and/or Pinterest between 4:00PM CDT, August 14, 2023 and 6:00PM CDT, August 16, 2023 (“Contest Period”). For purposes of these Contest, “receipt” of an entry, and acceptance of these official rules, occurs when Sponsor receives a fully filled out Entry Card, and records the entry information resulting from the entrant submitting a photograph in accordance with the guidelines above. Automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated service) are not permitted and will be disqualified. All entries become the property of Sponsor and will not be returned. The winner must meet the eligibility requirements set forth in these rules in order to qualify for the prize. Limit one entry per Facebook, Instagram, X f/k/a Twitter or Pinterest page. Sponsor is not responsible for lost, late, misdirected, incomplete or illegible entries. Sponsor is not responsible for any failure of the website or any applications during the Contest Period, including any telephone problems or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of traffic congestion on the internet or at the website or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from downloading any material related to the Contest, all of which may affect a person’s ability to participate in the Contest.
WINNER SELECTION: There will be one winner. The winner will be identified on August 21, 2023. Criteria for winner selection shall be whichever original, individual entry posted by an entrant receives the most total likes on their post to Facebook, Instagram, X f/k/a Twitter or Pinterest (collectively, “Engagement”) during the Contest Period. An entrant may post on Facebook, Instagram, X f/k/a Twitter and/or Pinterest, but only Engagement for each post on each respective platform will count towards winner selection. The winner will be notified by email or mail at the discretion of the Sponsor. The Sponsor’s determination of the winner is final.
A winner may be disqualified, at Sponsor’s sole discretion, if it violates the rules of Facebook, Instagram, X f/k/a Twitter or Pinterest in pursing any Engagement of its entry posts, including without limitation by specifically requesting individuals post to their personal pages the entries in order to increase the entrant’s total Engagement.
PRIZES: The Sponsor will make available to winner one Echo Dot Smart Speaker, having an approximate fair market value of $49.99 (“Grand Prize”). Only the prize specified above will be awarded. The prize is non-transferable, with no cash redemption or equivalent. All federal, state and local income taxes, insurance, licensing, registration and title fees connected to the prize are the sole responsibility of the winner. Prizes valued over $600.00 will be reported as taxable income, in accordance with IRS regulations. All federal, state and local laws and regulations apply. Sponsor shall only be responsible for awarding the number of prizes as stated in these rules. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prizes awarded. Sponsor makes no representation or warranties concerning the appearance, safety or performance of any prizes awarded.
CLAIMING PRIZE: All properly claimed Prizes will be awarded. As a condition of winning the Prize, the winner must complete, sign and return an affidavit of eligibility and liability and publicity release, where permitted by law, and any other applicable forms required by a taxing authority within ten (10) days of receipt of written prize notification or the Prize will be forfeited and assigned to the next entry with the most Engagement during the Contest Period, and so on. Further, by accepting the Prize, the winner consents to Sponsor’s use of their name, photograph and/or likeness, address, voice and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law.
If any correspondence of the Sponsor or any Prize is returned as undeliverable, the corresponding Prize will be forfeited and will be awarded to an alternate winner. Should a winner make any false statement(s) in any document referenced above, the Sponsor may take all reasonable actions available to it at law and equity, including without limitation request that the purported winner reimburse Sponsor the Prize amount, in which case Sponsor will reissue the Prize to the next eligible winner. In the event there is a dispute of the entrant’s identity, the Prize will be awarded to the established email account associated with the entry.
In case of dispute as to the identity of any online entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry. As used in this Contest, “Authorized Account Holder” is defined as the natural person who is assigned an email address by an internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry.
PRIVACY: Sponsor will be collecting personal data about entrants in accordance with its privacy policy. Please review the Sponsor’s privacy policy at https://www.2-10.com/privacy-policy/. By participating in the Contest, you hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.
LIMITATION OF LIABILITY: By participating in this Contest, entrants agree to release, hold harmless and agree not to institute any claim against Sponsor and all co-sponsors of the Contest and each of their respective parent companies, affiliates, subsidiaries, and their respective officers, directors, employees, agents and representatives, as well as Facebook, Instagram, X f/k/a Twitter and/or Pinterest and each of its respective parent companies, affiliates, subsidiaries, and their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, 1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; and/or 2) participation in the Contest or any prize related activities, including but not limited to traveling to or from any prize related activity. Upon delivery of the prize to the winner, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize.
Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest, including any injury or damage to your or any other person’s computer relating to or resulting from participating in this Contest or downloading any materials in this Contest.
Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby, to the fullest extent permitted by law, waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and entrants further waive all rights to have damages multiplied or increased.
These Rules shall not be enforceable by, and Sponsor shall have no responsibility to or liability in connection with, any third-party entity or individual.
This Contest is in no way sponsored, endorsed, administered by or associated with Facebook, X f/k/a Twitter, Instagram, or Pinterest.
MISCELLANEOUS CONDITIONS: If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select the winner from among all eligible entries prior to the cancellation. Persons found tampering with or abusing any aspect of this Contest, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors.
CHOICE OF LAW & VENUE: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Colorado, without regard to Colorado’s conflict of law principles. Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Denver, Colorado.
CONTEST RULES: These Official Rules will be posted on Sponsor’s website at www.2-10.com/kwmac-2023-terms-and-conditions during the Contest Period. WINNER LIST: To obtain a winner list by mail, send a self-addressed stamped envelope to: 2-10 HBW Attn: Marketing, Re: Keller Williams Mega Camp Contest 2023, 13900 E Harvard Ave, Aurora, CO 80014. Requests must be received by February 22, 2021.
